Defending claims against your business
Receiving an employment tribunal claim can be unsettling, but it is important to act quickly. An employer usually has 28 days from the date the claim is sent to submit its response, known as the ET3. If no response is received in time, the tribunal may decide the claim without hearing from you. We review the claim, advise on its merits and prepare a response that sets out your defence clearly.
After the response, the case moves through preliminary hearings, case management orders, disclosure of documents and the exchange of witness statements. Each stage has deadlines, and missing them can harm your case. We manage the process for you, prepare your witnesses and keep you informed of costs and options, including whether settlement makes sense at any point.
At Liberty Law Solicitors, we believe in face-to-face representation. Rather than relying solely on phone and email, we attend hearings with our clients. Our lawyers combine the litigation skills of a solicitor with the in-court experience of an advocate, and that experience of how judges approach cases informs how we prepare and present your defence.
We also act in the Employment Appeal Tribunal, where our director Attiq Malik successfully argued a point that clarified the time limit for claims following ACAS conciliation. Where an employment dispute belongs in the civil courts, such as some contract claims or applications to enforce restrictive covenants, we can act for you there too.
