Renegotiating your terms
A settlement agreement is an offer, and offers can often be discussed. Whether you want a pre-agreed settlement finalised quickly or would like us to renegotiate with your employer, we act on your instructions and goals, with a resolute and professional approach. Before anything is put to your employer, we agree with you what you want to achieve and what you would be prepared to accept.
Negotiation starts with understanding your position. We advise you on any claims that may arise from the end of your employment, assess what they could be worth and consider whether the sum offered reasonably reflects your circumstances. That gives you a clear basis for deciding whether to accept or ask for more.
A better package is not only about the headline figure. We look at notice and holiday pay, the timing of payments, references, confidentiality, any restrictions on future work and your employer’s contribution to your legal fees. We also look for gaps in the drafting and clauses worded against you, so they can be raised alongside the figure.
We cannot promise your employer will agree to changes, and every negotiation carries some risk. An employer can withdraw an offer, so we explain the risks clearly at each stage and report back on every response. The decision on how far to push, and when to accept, always stays yours.
